Terms & Conditions
Skyward Consulting Group, LLC
Effective Date: October 17, 2026
Website: www.skyward-consultinggroup.com
1. Acceptance of Terms
These Terms & Conditions govern the use of Skyward Consulting Group, LLC's ("SCG," "Company," "we," "us," or "our") website, educational materials, and consulting services.
By using this website, you agree to these Terms to the extent permitted by applicable law.
Paid consulting engagements are additionally governed by a separate Consulting Services Agreement that must be affirmatively accepted before services begin. In the event of a conflict, the Consulting Services Agreement governs the specific engagement, subject to applicable law.
2. Eligibility
SCG's website, consulting services, and educational programs are intended exclusively for individuals 18 years of age or older.
Individuals purchasing services on behalf of a business represent that they have authority to enter into agreements on behalf of that business.
3. Nature and Scope of Services
SCG provides business startup consulting, marketing and growth strategy, business development guidance, operational assessments, process improvement recommendations, and automation planning.
SCG provides strategic guidance, assessments, and actionable recommendations.
SCG DOES NOT IMPLEMENT, MANAGE, OR OPERATE A CLIENT'S BUSINESS UNLESS EXPRESSLY AGREED OTHERWISE IN WRITING.
Clients retain responsibility for implementing recommendations, managing operations, supervising employees, and making business decisions.
Each consulting engagement is limited to the services and deliverables identified in its approved scope of work.
4. Payment and Refund Policy
ALL PAYMENTS ARE FINAL AND NONREFUNDABLE, EXCEPT WHERE OTHERWISE REQUIRED BY APPLICABLE LAW OR EXPRESSLY PROVIDED IN THE APPLICABLE WRITTEN AGREEMENT.
Consulting fees compensate SCG for professional time, appointment reservations, preparation, research, strategic analysis, and agreed deliverables.
A client's decision not to implement recommendations, dissatisfaction with business results, or failure to achieve anticipated outcomes does not, by itself, entitle the client to a refund.
Where SCG fails to deliver contracted services, applicable contractual remedies and legally required consumer protections remain available.
All fees and applicable payment terms will be disclosed before purchase.
5. Appointments, Cancellations, and Rescheduling
Consulting appointments are scheduled through SCG's authorized booking process.
Clients are responsible for attending scheduled appointments and providing requested information.
Cancellation, rescheduling, no-show, and late-arrival policies will be disclosed in the applicable service description or Consulting Services Agreement.
SCG may reschedule appointments when reasonably necessary and will provide appropriate remedies consistent with the applicable agreement and law.
6. No Guarantee of Results
SCG DOES NOT GUARANTEE BUSINESS SUCCESS, REVENUE, PROFITS, SALES, LEADS, COST SAVINGS, OR RETURN ON INVESTMENT.
Business outcomes depend on numerous factors beyond SCG's control, including:
-
Market conditions and economic developments
-
Competition and consumer behavior
-
Available capital and business resources
-
Client decisions and execution
-
Regulatory changes
-
Technology and third-party performance
-
Management capabilities and operational conditions
Past performance, case studies, projections, examples, and hypothetical scenarios do not guarantee future results.
7. Client Responsibilities
Clients are responsible for providing accurate, complete, and timely information.
Clients retain responsibility for evaluating recommendations, making independent business decisions, implementing strategies, and obtaining specialized professional advice.
SCG is not responsible for consequences attributable solely to inaccurate client information, failure to implement recommendations, unauthorized modifications, or independent client decisions, except where otherwise required by applicable law or SCG's own contractual obligations.
8. No Legal, Tax, or Regulated Financial Advice
SCG is not a law firm, accounting firm, registered investment adviser, or financial planning firm.
SCG does not provide legal advice, tax advice, securities investment recommendations, or other regulated professional services outside its authorized scope.
Clients are responsible for consulting qualified attorneys, accountants, tax professionals, or other licensed professionals when necessary.
9. Intellectual Property and Business Name Protection
SCG may provide business naming, branding, marketing, and strategic development recommendations.
SCG does not guarantee the legal availability, ownership, registration, or enforceability of proposed business names, logos, slogans, trademarks, copyrights, patents, or other intellectual property.
Clients are responsible for obtaining appropriate trademark searches, legal clearance, intellectual property protection, and necessary registrations.
A business entity registration or domain name registration does not necessarily establish trademark rights.
Clients acknowledge that failure to secure appropriate legal protection may result in disputes, additional expenses, loss of business opportunities, or the need to rebrand.
SCG is not responsible for consequences attributable to a client's failure to obtain recommended professional assistance or complete necessary filings, except where liability arises from SCG's own actionable conduct or contractual obligations.
10. Third-Party Professional Referrals
SCG may recommend independent attorneys, accountants, technology providers, marketing specialists, insurance professionals, or other service providers.
CLIENTS ARE NEVER REQUIRED TO USE A PROFESSIONAL REFERRED BY SCG.
Clients may select any appropriately qualified professional.
Clients remain responsible for evaluating providers, engaging their services, paying applicable fees, and completing recommended actions.
Unless otherwise disclosed, referred providers operate independently and are not employees or agents of SCG.
SCG does not guarantee independent providers' qualifications, conduct, fees, performance, or results.
SCG is not responsible for the independent misconduct or contractual breaches of third parties, except to the extent liability arises from SCG's own conduct or is otherwise imposed by law.
Any material referral compensation or financial relationship will be disclosed where required.
11. Changes in Business Direction
Consulting packages are limited to the business concept, industry, products, services, and objectives identified in the approved engagement.
If a client materially changes their business concept or abandons the original venture in favor of a substantially different enterprise, the revised project may require a new consulting agreement and additional fees.
For example, a client who purchases a business launch plan for a bicycle company cannot automatically transfer that engagement to an unrelated running shoe business.
A MATERIAL CHANGE IN BUSINESS DIRECTION DOES NOT ENTITLE THE CLIENT TO A COMPLIMENTARY REPLACEMENT CONSULTING PACKAGE.
Any unused services, credits, or payments remain subject to the applicable agreement and law.
Ordinary refinements within the agreed scope will not automatically constitute a new engagement.
12. Business Expansion and Additional Services
Clients expanding an existing business through new products, service lines, locations, or markets may request additional consulting.
Such work may be offered through a separately priced Product or Service Line Launch engagement.
Additional services, rebranding, revised strategies, or new deliverables outside the original scope require a written change order or separate agreement.
SCG will disclose applicable fees and obtain approval before beginning additional billable work.
Additional fees will not be imposed merely to correct work for which SCG is legally or contractually responsible.
13. Artificial Intelligence and Technology-Assisted Services
SCG may use artificial intelligence, automation technologies, and digital research tools to support research, analysis, proposal preparation, strategic planning, and consulting deliverables.
SCG IS A HUMAN-LED CONSULTING FIRM. ARTIFICIAL INTELLIGENCE SUPPORTS, BUT DOES NOT REPLACE, PROFESSIONAL JUDGMENT AND EXPERTISE.
SCG exercises professional oversight over its consulting recommendations and reviews AI-assisted materials as appropriate to the engagement.
AI-assisted information may contain inaccuracies, omissions, or outdated information. No technology-assisted recommendation guarantees a particular business outcome.
Client information will be handled in accordance with applicable confidentiality obligations, the Privacy Policy, and any additional contractual safeguards.
14. Confidentiality
SCG and its clients may exchange confidential business information during consulting engagements.
Specific confidentiality obligations, exceptions, authorized disclosures, and data-handling responsibilities will be established in the Consulting Services Agreement.
SCG will handle personal information in accordance with its Privacy Policy.
15. Ownership and Use of Consulting Materials
Unless otherwise agreed in writing, SCG retains ownership of its proprietary methodologies, templates, training materials, educational resources, and other preexisting intellectual property.
Clients receive the rights to use purchased consulting deliverables for their own internal business purposes as specified in the applicable Consulting Services Agreement.
Unauthorized reproduction, redistribution, resale, or commercial exploitation of SCG's proprietary materials is prohibited to the extent permitted by law.
16. Fraud, Impersonation, and Unauthorized Third Parties
SCG is not responsible for independent third parties who impersonate the Company, misuse its branding, make unauthorized representations, or engage in fraudulent activity without SCG's authorization or involvement.
SCG does not guarantee that third parties will refrain from copying business concepts, misusing intellectual property, or engaging in unlawful conduct.
Nothing in this provision excludes liability arising from SCG's own negligence, misconduct, security failures, or other nonwaivable obligations.
17. Professional Conduct and Public Statements
Clients and website users must not engage in unlawful harassment, threats, impersonation, or knowingly publish false statements of fact that constitute actionable defamation.
SCG reserves the right to pursue lawful remedies for defamatory statements, harassment, intellectual property infringement, or other unlawful conduct.
Nothing in these Terms prohibits truthful reviews, honest opinions, good-faith complaints, reports to government authorities, or other legally protected communications.
18. Dispute Resolution
SCG encourages clients to submit concerns in writing so that the parties may attempt to resolve disputes informally.
Where the parties validly agree, disputes may be subject to negotiation, mediation, or binding arbitration under the procedures stated in the separately accepted Consulting Services Agreement.
Any class-action waiver, arbitration provision, forum-selection clause, or other dispute-resolution requirement must be legally enforceable and will remain subject to applicable nonwaivable rights.
These Terms do not eliminate rights or remedies that cannot lawfully be waived.
19. Limitation of Liability
To the fullest extent permitted by applicable law, SCG's liability arising from paid consulting engagements will be governed by the limitations and remedies established in the applicable Consulting Services Agreement.
Such agreements may contain legally enforceable limitations on certain damages, exclusions of indirect or consequential losses, and agreed maximum liability amounts.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
20. Website Use and Security
Users agree not to interfere with website operations, attempt unauthorized access, distribute malicious software, misuse SCG's content, or engage in unlawful activity through the website.
SCG may restrict access where reasonably necessary to address security concerns, unlawful conduct, or material violations of these Terms.
21. Privacy and Communications
Personal information is handled in accordance with SCG's Privacy Policy.
Administrative communications may be sent in connection with inquiries, purchases, and consulting engagements.
Promotional email or SMS communications, if offered, are subject to applicable consent and opt-out requirements.
Use of the website does not automatically constitute consent to promotional communications.
22. Changes to Terms
SCG may revise these Terms as its services, operations, or applicable legal requirements change.
Updated Terms will be posted with a revised effective date.
Material changes affecting existing paid engagements will be handled in accordance with applicable law and the relevant Consulting Services Agreement.
23. Governing Law
The governing law, jurisdiction, and dispute-resolution procedures for paid engagements will be identified in the applicable Consulting Services Agreement, subject to mandatory laws and applicable consumer protections.
